Delivery
We deliver the ordered goods to the delivery address you provided during the order process.
Self-collection of the ordered goods is not possible.
Retention of Title
If we provide goods in advance (e.g., in the case of purchase on account), they remain our property until full payment of the purchase price has been made.
Warranty
Statutory warranty rights apply.
Transport Damage
If goods are delivered with obvious transport damage, please report such defects to the shipping or transport service provider immediately if possible and contact us without delay.
Failure to make a complaint or contact us will not affect your legal or contractual warranty rights and their enforcement. However, it helps us assert our own claims against the shipping or transport company or the transport insurance.
Dispute Resolution
We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
Choice of Law
The law of the Federal Republic of Germany shall apply, excluding the provisions of international private law and the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer, the mandatory legal provisions of the country in which you reside shall remain unaffected.
Place of Jurisdiction
If you are a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with the contract shall be our registered office.
3. Right of Withdrawal
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last item.
To exercise your right of withdrawal, you must inform us (On Gods Path UG, Drakestraße 48, 12205 Berlin, Email: office@ongodspaths.com) by means of a clear declaration (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not required.
To meet the withdrawal deadline, it is sufficient that you send the notice regarding your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the date on which we received notice of your withdrawal from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the returned goods or until you have supplied evidence of having sent back the goods, whichever is earlier.
You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusions from the Right of Withdrawal
The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for which an individual choice or decision by the consumer is decisive, or that are clearly tailored to the consumer's personal needs.
The right of withdrawal does not apply to contracts for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
The right of withdrawal does not apply to contracts for the delivery of newspapers, periodicals, or magazines, with the exception of subscription contracts.
The right of withdrawal does not apply to contracts for the delivery of goods whose price is dependent on fluctuations in the financial market which cannot be controlled by the entrepreneur and which may occur within the withdrawal period.
Linked/Financed Transactions
If you have financed this contract by means of a loan and later withdraw from it, you are also no longer bound by the loan agreement, provided that both contracts form a single economic unit. This is particularly likely if we are also your lender or if your lender uses our cooperation in granting the loan.
If the loan has already been disbursed to us when the withdrawal becomes effective or when the goods are returned, your lender will assume our rights and obligations under the financed contract in relation to you. This does not apply if the subject of this contract is the acquisition of financial instruments (e.g., securities, foreign exchange, or derivatives).
If you wish to avoid a binding obligation as far as possible, exercise your right of withdrawal for both the purchase contract and, if applicable, the loan agreement.
